Welcome to the Peloton Concierge Maintenance Program (PCMP) . These terms of service, (“Terms”) govern your access to and use of PCMP websites and mobile applications (“the Site”). By accessing or using the Site, you are agreeing to these Terms with PCMP (“we”, “us”, “our”). Do not access or use the Site if you are unwilling or unable to adhere by the Terms.

1. Definitions

• User: You, as the visitor and/or user of our Site. Includes all persons and entities legally accessing our services.
• Content: Text, images, audio, video, and all other forms of data or communication.
• Your Content: Content that you submit or transmit to, through, or in connection with the Site, such as ratings, reviews, compliments, invitations, and information that you publicly display or displayed in your account profile.

• Site Content: All of the Content that is made available on the Site, including Your Content, User Content, and Our Content.

• Misuse of the Site: You may not (a) interfere with the security-related features of the Site; (b) damage, disable, overburden, or impair the Site; (c) post or transmit any malicious or invasive code; (d) use the Site to send spam or unsolicited messages; (e) impersonate another user.

Disclaimers and Limitation of Liability Please read this section carefully since it limits the liability of PCMP and its affiliates, officers, directors, employees, agents, and licensors (collectively, the “PCMP Entities”). Each of the subsections below only applies up to the maximum extent permitted under applicable law. Some jurisdictions do not allow the disclaimer of implied warranties or the limitation of liability in contracts, and as a result, the contents of this section may not apply to you.

• No Warranties: The Site and all data, information, software, website materials, content, services, or applications made available in conjunction with or through the site are provided on an “as is,” “as available,” and “with all faults” basis. No advice, or information, whether oral or written, obtained by you from PCMP Entities or through the site will create any warranty not expressly stated herein.
• Limitation of Liability: Under no circumstances, including, but not limited to, negligence, will PCMP Entities be liable for any direct, indirect, special, incidental, consequential, or exemplary damages arising out of or in connection with your use or inability to use the site and services.

7. General Terms These Terms constitute the entire agreement between you and PCMP concerning your use of the Site. Our failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. If any part of these Terms is found to be invalid, the remaining portions will remain in full force and effect. If we do not enforce any part of these Terms, it will not be considered a waiver.
